1. General Principles

1.1. These Terms of Sale apply to the legal relationships arising between the customers (hereinafter the Customer) of the online store www.myhedon.com and the owner of the online store, Nuevo OÜ, registration code 11353782, located at Kõrre tn 19, Tallinn (hereinafter Myhedon.com), when purchasing goods.

1.2. In addition to the Terms of Sale, the relationship between the Customer and Myhedon.com is regulated by the laws in force in the Republic of Estonia, government regulations, established good practices, and common sense.

1.3. If any point of the Terms of Sale contradicts the laws of the Republic of Estonia, the laws of the Republic of Estonia shall prevail.

1.4. Myhedon.com reserves the right to change these Terms of Sale due to changes in legislation or the business environment. Changes to the Terms of Sale take effect from the moment the information appears on the Terms of Sale page of the online store. If the Customer placed their order before the changes to the Terms of Sale took effect, the conditions in force at the time the order was submitted apply to the Customer, unless otherwise provided by law.

1.5. By placing an order in the online store www.myhedon.com, the Customer confirms that they have read and agree to the Terms of Sale.


2. Product Information and Prices

2.1. The prices of goods sold in the Myhedon.com online store are in euros and include 24% VAT.

2.2. Product prices do not include delivery fees. The delivery fee depends on the delivery method chosen by the Customer.

2.3. Myhedon.com reserves the right to adjust product prices according to changes in purchase prices.

2.4. If the Customer placed their order before a price change, the price indicated in the order confirmation applies.

2.5. Additional information is provided with each product in the Myhedon.com online store, which should be reviewed to ensure the product’s suitability.

2.6. Prices for products sold in the online store are listed next to the products. All prices in the online store are in euros.


3. Shopping Cart and Placing an Order

3.1. The Customer’s Shopping Cart is created the moment they click the “Add to cart” button.

3.2. Adding a product to the Shopping Cart does not commit the Customer to a purchase.

3.3. The Customer can change the quantity of products in the Shopping Cart and remove them if necessary.

3.4. Products in the Shopping Cart remain available to other Customers until the order is confirmed.

3.5. When placing an order, the Customer selects their preferred delivery method and checks that the Recipient’s details are correct.

3.6. The purchase-sale agreement is considered concluded between the Customer and Myhedon.com once the Customer has clicked the “Confirm order” button to submit the order.

3.7. After clicking the “Confirm order” button, an order confirmation is sent to the Customer’s email.

3.8. If the order confirmation has not arrived within 1 hour, please contact Myhedon.com online store customer support at the address hello@myhedon.com


4. Payment for Ordered Goods

4.1. Ordered goods can be paid for conveniently during the checkout process via an online banking link. The payment link service provider is Montonio Finance UAB. Credit card payments are processed by Stripe Inc. Payments can be made in euros.

4.2. After completing the purchase, an order confirmation/invoice is sent to the Customer’s email.

4.3. If the Customer did not pay via a bank link during checkout (selected bank transfer as the payment method), they will find Myhedon.com bank details for payment on the order confirmation received by email. In this case, Myhedon.com expects the Customer to pay for the goods within 24 hours of placing the order. If payment is not received within 24 hours, the order will be cancelled.

4.4. Payments are mediated by Montonio Finance OÜ. Payment takes place outside the Online Store in a secure environment – in the secure environment of the respective bank when paying via bank link, and in the secure environment of Montonio Finance UAB when paying by credit card. The Seller does not have access to the customer’s bank or credit card details. The agreement takes effect from the receipt of the amount due in the Online Store’s bank account.

4.5 The owner of the online store is the controller of personal data and transmits the personal data necessary for making payments to the separate controller Montonio Finance UAB.


5. Delivery of Goods

5.1. After payment for the order, the goods will be delivered to the Customer. The Myhedon.com online store ships goods to parcel machines across Estonia. Delivery of products in stock takes 3-5 business days within Estonia. Orders are not posted on weekends or public holidays.

5.2. The Customer can choose between the following delivery methods:

5.2.2. SmartPost/Omniva Estonia/DPD. The Customer will receive a message when the package has arrived at their chosen parcel machine.


6. Returning/Exchanging Goods

6.1. If the goods are not suitable or do not meet the Customer’s expectations, the Customer has the right to return or exchange them within 14 days of receiving the goods. There is no right of withdrawal for the following goods (according to § 53 (4) of the Law of Obligations Act):

4-1) delivery of a product in a sealed package that is not suitable for return for health protection or hygiene reasons and if it has been opened after delivery.

6.2. The Customer must notify their desire to return within 14 days of receiving the goods by filling out the order return application HERE.

6.3. The returned goods must be unused, with tags, and in the original packaging. To exercise the 14-day right of return, the ordered goods must not be used in any way other than what is necessary to verify the nature, characteristics, and functioning of the goods in the same way as is permitted for testing goods in a physical store.

6.3.1. If the goods have been used for purposes other than those necessary to verify the nature, characteristics, and functioning of the goods, or if they show signs of use or wear, the online store has the right to reduce the refundable amount in accordance with the decrease in the value of the goods.

6.3.2. For hygiene reasons, a used/tested product cannot be returned, unless it is a defective/faulty product. Be sure of your purchase before buying and check the contraindications on the product page!

6.4. The costs of returning the goods are borne by the Customer, except when the reason for the return is non-compliance with the order or defective goods.

6.5. Money for the returned goods will be refunded to the Customer immediately, but no later than 14 days after receiving the withdrawal application. In addition to the cost of the returned goods, the delivery costs will also be refunded.

6.6. The Customer can contact the Consumer Disputes Committee of the Consumer Protection and Technical Regulatory Authority, which has the competence to resolve disputes arising from the contract if the cost of the disputed goods is over €20 (review of the complaint by the committee is free). 6.7. The online store has the right to withdraw from the sales transaction and demand the goods back from the buyer if the price of the goods in the online store is marked significantly below the market price due to an error.

7. Liability and Force Majeure

7.1. Myhedon.com is liable to the Customer for damage caused by Nuevo OÜ’s breach of these terms in the cases and to the extent provided by the legislation in force in the Republic of Estonia.

7.2. The Customer is liable to Myhedon.com for damage caused by the Customer’s breach of these terms in the cases and to the extent provided by the legislation in force in the Republic of Estonia.

7.3. Neither party is liable to the other party, and their behavior is not considered a breach of these terms due to any delay or failure to perform any obligation, if the reason for said delay or failure was beyond the control of that party (force majeure).

7.4. Myhedon.com does not compensate for moral damage that may be caused to the Customer by changes in delivery times, prices, and other conditions within the framework of these terms.


8. Protection of Personal Data and Data Security

8.1. The online store collects the Customer’s personal data when creating a customer account and/or placing an order.

8.2. Myhedon.com stores the contact details entered by the Customer during the purchase process and information about the purchases made. This information is treated as confidential and processed in accordance with the Personal Data Protection Act.

8.3. The personal data processed includes the Customer’s name, email address, mobile phone number, and postal address.

8.3. Myhedon.com uses the personal data provided by the Customer only to fulfill the Customer’s purchase order.

8.4. By entering data in the online store and providing the corresponding confirmation, the Customer gives the right to collect and process the Customer’s personal data and to transmit the necessary data to logistics partners for the delivery of goods.

8.5. Myhedon.com does not disclose information obtained during purchases to third parties, except to partners Smartpost, Omniva and DPD for the delivery of goods.

8.6. The Customer has the right at any time to prohibit the collection and use of their personal data. Consent for the use of the aforementioned personal data cannot be withdrawn retroactively. The Customer also has the right to see, change, and delete the personal data collected about them. To do so, please contact the person responsible for personal data protection.

8.7. Data communication between the Customer and banks and the card payment center is encrypted, ensuring the security of the Customer’s personal and bank data.
Payment takes place outside the Myhedon.com online store environment, in the secure payment environment of the respective bank or service provider. The Myhedon.com online store does not have access to the Customer’s bank and credit card details.

8.8. Paying in the Myhedon.com online store is safe and easy. By choosing a bank link, the Customer is directed to the internet bank of the respective bank, where the payment can be made securely within the banking system. By choosing VISA or MasterCard for payment, the Customer is directed to the secure environment of Montonio Finance UAB. There is a pre-filled payment order stating the amount to be paid. After entering the card number, security code (3-digit code on the back of the card), and card expiration date, Montonio Finance UAB authorizes the transaction with the Customer’s bank. When asking for card details, the SSL security protocol and MasterCard SecureCode and Verified by Visa security programs are used, ensuring that the information exchanged cannot be intercepted or changed by unauthorized persons. The board of Nuevo OÜ is responsible for the protection of personal data.


9. Use of Cookies

9.1. Myhedon.com uses text files called “cookies,” which are intended to help develop the online store and ensure the best user experience for the Customer.

9.2. The use of cookies may also involve the processing of Personal Data. By using the Myhedon.com online store, you give your consent to the use of cookies in accordance with the description provided here (unless you have set your browser not to accept cookies). Disabling cookies may limit the convenience and possibilities of using the Myhedon.com online store.

9.3. The Myhedon.com online store uses Google Analytics software to track traffic. This software uses analytical cookies to identify visitors’ time spent on the site. These cookies are used for statistical purposes only, and individual users cannot be identified through them. Visitors’ personal data is not transmitted to Google.

9.4. The Myhedon.com online store uses technical cookies to ensure functionality, without which it would not be possible to make purchases from the online store.

9.5. The Myhedon.com online store uses authentication cookies to authenticate users.


Restricting or completely opting out of cookies

10. Other Conditions

10.1. Disagreements and disputes arising from the fulfillment of these terms of sale are resolved by the parties primarily through negotiations. If the differences cannot be resolved through negotiations, the Customer has the right to contact the Consumer Disputes Committee.
